Accused in S.C.No.984/2024 pending before the Court of XIII Additional City Civil and Sessions Judge, at Mayohall, Bengaluru, arising out of Crime No.185/2024 registered by Kadugondanahalli Police Station, Bengaluru, for offence punishable under Section 302 of IPC, is before this Court in this successive bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard learned counsel appearing for the petitioner and learned HCGP appearing for the respondent-State. 3. Petitioner had earlier approached this Court in Criminal Petition No.12135/2024 and Criminal Petition No.3234/2025, which were dismissed as withdrawn before this Court on 12.12.2024 and 21.07.2025 respectively. - 3 - HC-KAR NC: 2026:KHC:31298 CRL.P No. 4498 of 2026 Subsequently, the petitioner had filed Criminal Petition No.14285/2025, which was dismissed on merits on 19.11.2025 with a direction to the Trial Court to record the evidence of CW1 to CW7 within a period of two months from the date of receipt of certified copy of the said order. 4. However, the order sheet of the Trial Court would reflect that the order passed in Criminal Petition No.14285/2025 is not produced before the said Court till date. Petitioner is in custody in the present case from 09.04.2024 onwards. 5. In view of the aforesaid and also having regard to the order dated 19.11.2025 passed in Criminal Petition No.14285/2025, this Criminal petition is disposed of with a direction to Trial Court to record the evidence of CW1 to CW7 within a period of two months from the date of receipt of certified copy of this order. 6. It is needless to state that the petitioner shall be at liberty to file a fresh bail application after examination of - 4 - HC-KAR NC: 2026:KHC:31298 CRL.P No. 4498 of 2026 CW1 to CW7 or after expiry of the period of two months from the date of receipt of copy of this order by the trial Court, whichever is earlier.
