Sinha, Advocate For the State : Mr. Manoj Kr. Mishra, Addl.P.P ------ Order No.04 Dated- 19-08-2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with S.T. Case No.25 of 2026 arising out of Ichak P.S. Case No.49 of 2021 registered for the offences punishable under Sections 147, 148, 149, 341, 353, 307, 387, 411 and 414 of the Indian Penal Code and under Section 25(1-b)(a), 26 & 35 of the Arms Act. This is the second journey of the petitioner with the prayer for regular bail, earlier the prayer for regular bail of the petitioner was dismissed as withdrawn vide order dated 17.04.2026 in B.A. (Filing) No.7399 of 2026. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was member of an unlawful assembly and in prosecution of the common object of the assembly was involved in extortion and fire upon police personnel who went to the place of occurrence after information was lodged in the police station by the victim to whom the extortion call was made of Rs.10 lakhs. It is next submitted that the allegations against the petitioner are all false. It is then submitted that the petitioner has been implicated in this case only on the basis of confessional statement of the co-accused Arun Mondal. It is also submitted that charge has been framed in this case but no witness has been examined as yet. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant/victim or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 14.07.2025 as has been mentioned in para-12 of this bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl.P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Hazaribagh in connection with S.T. Case No.25 of 2026 arising out of Ichak P.S.
