BEFORE HONOURABLE MR. JUSTICE MANISH CHOUDHURY ORDER Date : 26.02.2026
Heard Mr. R.J. Das, learned counsel for the applicant; Mr. S. Bora, learned Standing Counsel, GDD & GMC for the opposite party nos. 1 – 5. 2. The applicant herein is the writ petitioner in the accompanying writ petition, W.P.[C] no. 880/2026. This Court while issuing notices to the respondents, passed an interim order on
17.02.2026. 3. The instant interlocutory application is preferred seeking certain corrections in Paragraph 4 and Paragraph 10 of the Order dated 17.02.2026. Page No. 3/4
4. The Paragraph 4 and the Paragraph 10 read as under :-
4. However, a committee named as Centralised Tender Evaluation Committee decided to hold a review meeting on 13.12.2026 to re-evaluate the technical bids in respect of four packages including the Contract-Work under reference. The Centralised Tender Evaluation Committee decided that the required documents mentioned in the afore- stated clauses can be submitted even after issuance of the Letter of Acceptance [LoA] and at the time of signing the contract agreement. 10. The learned counsel for the petitioner shall take steps for service of notice upon the respondent nos. 6 – 7 by speed post by tomorrow [18.02.2026] from today. In addition, the petitioner, on prayer, is also permitted to take steps for service of notice upon the respondent nos.
6 – 7 by way of dasti, which is to be routed through the Registry of this Court. After service of notice upon the respondent nos. 6 – 7 by way of dasti, the petitioner shall also file a compliance affidavit to that effect before the returnable date. [emphasis supplied in bold]
5. The learned counsel for the parties are, in unison, in submitting that in Paragraph 4, the date of the review meeting ought to have been ‘13.02.2026’, instead of ‘13.12.2026’. As the private respondents are arrayed as the respondent nos. 6 – 8, the words, ‘the respondent nos. 6 – 7’ in Paragraph 10, ought to have been ‘the respondent nos. 6 – 8’ at the three places wherein they appeared. 6. The afore-quoted corrections sought for by this application are allowed as they are mere typographical errors. Accordingly, in Paragraph 4 instead of ‘13.12.2026’, it should be read as ‘13.02.2026’. Similarly in Paragraph 10, the words, ‘the respondent nos. 6 – 7’ are to be read as ‘the respondent nos. 6 – 8’ at three places wherein they appeared. 7. This order is to be treated to part and parcel of the order dated 17.02.2026 passed in W.P.[C] no. 880/2026 for all intents and purposes. Page No. 4/4
8. The instant applicant stands allowed to the extent indicated above. JUDGE Comparing Assistant
