The Court made the following: JUDGMENT:- (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)
This writ appeal is filed challenging the order of the learned Single Judge passed in I.A.No.2 of 2017 in W.P.No.44703 of 2017. 2.
Heard learned Assistant Government Pleader for Revenue for the appellants and learned counsel for the respondents 1 and 2. 3. The writ petitioners have approached the Committee constituted under G.O.Ms.No.300 dated 05.07.2016 for deletion of immovable property of the petitioners from the list of Section 22-A (1) (e) of the Registration Act, 1908. The said request was refused by the Committee. Challenging the same, they have filed the writ petition and in the interlocutory application, the learned Single Judge has ordered for suspension of the said order of the Committee. 4. Aggrieved by the said interim order, the State has preferred this appeal. 5. When the appeal came up for hearing, learned counsel for the respondents / writ petitioners submits that subsequently, G.O.Ms.No.258 Revenue (Assignment-IV) Department, dated 18.05.2018 was issued deleting the property of the writ petitioners from the purview of Section 22-A (1) (e) of the Registration Act, 1908 and as such, the grievance of the writ petitioners is adequately redressed. 6. The copy of the said G.O. was also furnished to the learned Assistant Government Pleader for Revenue. On instructions, learned Assistant Government Pleader for Revenue submits that it is a fact that the said G.O. was issued deleting the property of the writ petitioners from the purview of Section 22-A (1) (e) of the Registration Act, 1908. 7. In that view of the matter, nothing survives in this appeal for adjudication. 4
8. Therefore, recording the same, the Writ Appeal is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY
