1. By the present writ petition, the petitioner is challenging the
order dated 15/01/2026 Annexure P-1, whereby, he has been dismissed from service on the basis of judgment of conviction passed by the learned Special Judge(Prevention of Corruption Act), Jashpur in Special (ACB) Case No.01/2021. Learned counsel for the petitioner submits that the petitioner was serving as a Labour Inspector in the Labour Department of the State of Chhattisgarh. Alleging certain irregularities, the petitioner was arrested in connection with a corruption case and was consequently placed under suspension. Thereafter, the petitioner submitted a representation, which, upon due
consideration by the competent authority, resulted in the revocation of the suspension order. Learned counsel further submits that, by judgment dated 26.11.2025, the learned Special Judge (Prevention of Corruption Act), Jashpur convicted the petitioner and sentenced him to undergo R.I. for three years along with fine. Solely on the basis of the said conviction, respondent No. 2 passed the impugned order dismissing the petitioner from service. Being aggrieved by the
judgment of conviction and sentence, the petitioner preferred CRA No. 2674 of 2025 before this Court and vide judgment dated 11.03.2026, this Court acquitted the petitioner of all the charges levelled against him. Learned counsel further submits that, following his acquittal, the petitioner submitted a detailed representation dated 18.03.2026 before respondent No. 2 seeking cancellation of the dismissal order and reinstatement in service. However, despite the lapse of considerable time, no decision has been taken on the said representation.

Learned counsel for the State submits that the representation dated 18/03/2026, which was filed by the petitioner, the same
3 will be considered in accordance with law within a period of 40 days and necessary order will be passed thereafter.
4. I have heard learned counsel for the parties, perused the pleadings and documents.

Having considered the submissions advanced by learned counsel for the parties and the facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondent authorities to consider the petitioner's representation within a period of 40 days and to pass a necessary order in accordance with law, from the date of receipt of copy of this order.
6. It is made clear that this Court has not expressed any opinion on merits of this case, it is for the competent authority to consider the case of petitioner on its own merits. SD/-
