Kutlehria, Additional Advocate General. _____________________________________________________ Chirag Bhanu Singh, Judge (Oral) The petitioner has preferred the present petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (in short BNSS) impugning the order dated 24.08.2023 passed by learned Judicial Magistrate, Court No.II, Una, whereby he has been declared as a proclaimed offender under Section 82 of the Cr.P.C.
2. The learned counsel for the petitioner submits that the petitioner shall surrender before the learned trial Court forthwith.
3. In view of the aforesaid circumstances, the execution and operation of the impugned order dated 24.08.2023 shall remain stayed.
-2- ( 2026:HHC:39633 ) However, it is directed that the petitioner shall surrender before the learned trial Court. In case the petitioner not surrenders before the learned trial Court, it shall take necessary action as per law, keeping in view the specific provision, of Section 82(4) of the Cr.P.C..
3. The petition is disposed off in the aforesaid terms, so also pending miscellaneous applications, if any.
