The Court made the following: 3 THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI CIVIL RIVISION PETITION NO:288 of 2026 ORDER: Heard Ms. Arthi, learned counsel representing Sri K.V. Aditya Chowdary, learned counsel for the petitioner. 2. This petition was filed by the 1st defendant in the suit in O.S.No.207 of 2021 on the file of the learned XI Additional District Judge, Visakhapatnam. 3. The grievance raised is that the plaintiff/respondent filed a suit for specific performance of contract. The 1st defendant filed I.A.No.564 of 2023 seeking expert opinion. The said application was heard and orders were reserved on 04.09.2023. However, thereafter, the orders were not pronounced, and the suit is being proceeded with. 4. Considering the submissions and the grounds taken, by order dated 06.02.2026, a report was called for from the concerned Court. The report dated 18.02.2026 and the further report dated 01.04.2026 have been received. 5. As per the report, the present Presiding Officer joined on 19.04.2024. It has been submitted that, since thereafter at no point of time, the interim application was reserved for orders and the matter was not opened several times, as contended by the petitioner, except on 15.04.2024 by the predecessor-in-office on account of his transfer. 6. The docket copies annexed to the C.R.P at page No.10 shows that, in the application filed under Section 45 of the Indian Evidence Act (I.A.No.564 4 of 2023) on 04.09.2023, 14.09.2023, 27.09.2023 and 12.10.2023 as also on 02.11.202, it is mentioned in the docket order that ‘orders not ready’ and the next date was given. From the docket orders, it is evident that the dates were fixed for orders, but the orders could not be pronounced, for the reason that the orders were not ready. 7. However, the present officer has joined on 19.04.2024 and all those orders are prior to the joining of the officer. 8. As per the report, learned counsel for the applicant in I.A.No.564 of 2023 was heard on subsequent date, and the application is pending for disposal. 9. Considering the aforesaid as also that the application in I.A.No.564 of 2023 pertains to expert evidence, this Civil Revision Petition is disposed of finally with a direction to the learned Trail Court to expeditiously consider and decide I.A.No.564 of 2023, preferably within a period of two (2) months from the date of production of copy of this order. 10. The Civil Revision Petition is disposed of. 11. No order as to costs.
