JUSTICE VENKATESH NAIK T ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) Heard Sri N. Vageesha, learned counsel appearing for the appellants, and Sri Narasimha Prasad S.D., learned counsel appearing for the respondents. - 4 - HC-KAR NC: 2026:KHC:28715-DB RFA No. 24 of 2021 2. Learned counsel for the parties submit that all issues between the parties are settled in terms of the compromise petition. 3. The parties have filed a memorandum of compromise, which reads as follows: "(a) That with the intervention of friends and well- wishers, the parties have agreed to enter into this compromise petition to put an end to the litigation. The terms relating to this compromise petition is reduced into writing as under. (b) The appellants concede that the respondents have share in the suit schedule property. The parties have agreed to sell the suit schedule property to the prospective purchasers and divide the proceeds as under: i) If in the event the suit schedule property is sold for Rs.2 crores, the appellants shall together be entitled to 60% share in the sale consideration of Rs.2 crores. ii) The respondents together shall be entitled to remaining 40% share in the sale consideration of Rs.2 crores. - 5 - HC-KAR NC: 2026:KHC:28715-DB RFA No. 24 of 2021 iii) If the suit schedule property is sold for Rs.2 crores, the parties shall be entitled for 60%- 40% as aforesaid, and if the suit schedule property is sold for more than Rs.2 Crores, the parties shall be entitled for equal share in respect of the amount over and above Rs.2 crores in the sale consideration. iv) The parties shall endeavour to sell the suit schedule property within a period of 6 months from today. v) As per the request of the appellants, the Respondents have given up their claim in respect of mesne profits. vi) In terms of the same the above appeal may kindly be disposed of to meet the ends of justice." 4. The parties are also present in the Court today and are duly identified by the learned counsel appearing on their behalf. 5. Memorandum of compromise petition is accepted. 6. Registry is directed to draw the decree accordingly and to return the original documents to the appellants, on proper application and identification. In view of the disposal of the appeal, pending interlocutory applications do not survive for consideration, and they are, accordingly, dismissed.
