APP Mr. Arani Bhattacharya … for the State Mr. Amit Ranjan Pati Ms. Ilika Nag Mr. Avijit Chatterjee … for the de facto complainant Learned senior counsel representing the petitioner submits that it is alleged that there was a romantic relationship between the petitioner and the alleged victim. After the same turned sour, an FIR was registered. As per the allegations, the relationship started at a time when the alleged victim was married. Reliance is placed on a complaint made by the husband against the de facto complainant before learned Magistrate alleging that she was having an affair with a third person. Learned counsel for the de facto complainant opposes the prayer for anticipatory bail, relies on medical documents 2 and submits that the alleged victim is presently in the family way and she has conceived a child of the present petitioner. Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of witnesses and documents of online payments made by the de facto complainant to the petitioner. Considering the above, the other materials available in the case diary and the fact that the petitioner was having some kind of a relationship with the alleged victim for a considerable length of time, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner cooperate with the investigation, shall meet the investigating officer once a week till submission of report in final form and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, allowed. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
