Accused Nos.3 and 4 in Crime No.57/2026 registered by Konanakunte Police Station, Benglauru, for the offences punishable under Sections 316(1), 318(2), 336(3) and 61(2) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel of the parties. 3. FIR in Crime No.57/2026 was registered by Konanakunte Police Station, Bengaluru, for the aforesaid offences against Rakesh and others based on the first information submitted by Kumaresh, authorized officer of the Company known as 'Repco Home Finance Ltd.' Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.2529/2026 before the jurisdictional Sessions Court, which was rejected on 04.04.2026. Therefore, they are before this Court. 4. A reading of the first information would reveal that accused Nos.1 and 2 had approached the financing company - 3 - HC-KAR NC: 2026:KHC:30801 CRL.P No. 6412 of 2026 along with accused Nos.3 and 4 for the purpose of availing loan. The documents which were submitted by the borrowers were forwarded to the legal advisors of the financing company and after obtaining legal opinion and also the valuation report from the approved valuer of the financing company, the loan was sanctioned in favour of accused Nos.1 and 2 in the year 2024. The allegation now made against accused is that the documents which were submitted by the borrowers for the purpose of availing the loan are concocted documents. This Court has already granted anticipatory bail to accused No.1, 2 and some of the other accused persons. Petitioners have undertaken to cooperate with the police for the purpose of investigation. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the alleged offences is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release - 4 - HC-KAR NC: 2026:KHC:30801 CRL.P No. 6412 of 2026 the petitioners in the event of their arrest in Crime No.57/2026 registered by Konanakunte Police Station, Benglauru, for the offences punishable under Sections 316(1), 318(2), 336(3) and 61(2) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
