Petitioner, who is apprehending arrest in Crime No.93/2026 registered by Rajanukunte Police Station, Bengaluru, for the offences punishable under Sections 66(C) and 66(D) of the Information Technology Act, 2000, and Section 108 of BNS, 2023, is before this Court, in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.93/2026 was registered by Rajanukunte Police Station, Bengaluru, for the aforesaid offences against unknown persons based on the first information dated 13.04.2026, received from Gangadhar Venkateshan, father of deceased girl, who was aged about 19 years. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.10097/2026, which was dismissed by the jurisdictional Sessions Court on 08.05.2026. Perusal of the first information which was submitted on 13.04.2026 would reveal that daughter of the first informant, aged 19 years was staying in a hostel and was studying in Presidency College at Bengaluru. She had allegedly informed the first informant that for the last 3 to 4 months, she was receiving dirty and objectionable messages from an Instagram account with a fake ID. First informant's daughter had subsequently committed suicide by hanging herself in her Hostel room on 13.04.2026. It is under these circumstances, FIR was registered for the aforesaid offences against the accused persons, who were sending messages to the mobile phone of the deceased from Instagram account using fake ID. 5. During the course of investigation, accused No.1 - Yattakula Piyush, who is a student, has been arrested and a reading of his remand application would reveal that he allegedly was sending dirty and objectionable messages to the victim girl, from an Instagram account, which was being used by him with a fake ID. It appears that after accused No.1 was arrested, an enquiry notice has been issued to the petitioner herein on 04.05.2026 by the police and apprehending his arrest, he is - 4 - HC-KAR NC: 2026:KHC:30806 CRL.P No. 7201 of 2026 before this Court. Considering the developments in the case during the course of investigation as found in the remand application, I am of the opinion that the prayer made by the petitioner, who has no criminal antecedents needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order:- 6. The Criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.93/2026 registered by Rajanukunte Police Station, Bengaluru, for the offences punishable under Sections 66(C) and 66(D) of the Information Technology Act, 2000, and Section 108 of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. - 5 - HC-KAR NC: 2026:KHC:30806 CRL.P No. 7201 of 2026 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
