2. The petitioner is apprehending his arrest in connection with Ketar P.S. Case No.31 of 2026, for the alleged offences registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2), 109, 303(2) and 351(2) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Nagar Untari, Garhwa.

Learned counsel appearing for the petitioner submits that the informant has taken an electricity connection by way of hooking from the transformer and for that the villagers have objected and thereafter the altercation took place. He further submits that there are general and omnibus allegation against the petitioner and the petitioner happened to be lady. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.9 of the petition. On these grounds, he submits that anticipatory bail

may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of assault.

On perusal of the FIR it transpires that there are general and omnibus allegation against 16 accused persons and the petitioner is said to be a lady and the petitioner has got no criminal antecedent as disclosed in paragraph No.9 of the petition and the altercation took place while villagers were stopping the informant for taking connection by way of hooking. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Nagar Untari, Garhwa in connection with Ketar P.S. Case No.31 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
