02/13.08.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Petarwar P.S. Case No.60 of 2026, registered for the offence under Sections 316(2) and 318(4) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat.

Learned counsel appearing for the petitioner submits that the allegations are made that the father of this petitioner has taken the amount for selling a portion of land and the said amount has not been returned and in the meantime, his father has died and now the allegations are made that the petitioner is not returning the said amount. He submits that the agreement was entered into in the year 2018 between the late father of this petitioner and the informant and his father has died in the year 2020. He further submits that for recovery of the amount, the FIR has been lodged. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that the said amount was not being returned by the petitioner and in view of that the FIR has been lodged.

On perusal of the FIR, it transpires that the FIR has been lodged for recovery of the amount which was paid to the father of this petitioner pursuant to an agreement between the father of this petitioner and the informant and his father died in year 2020, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Petarwar P.S. Case No.60 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
