THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: (a) Set aside the Impugned Order C.P.(IB) No.251/BB/2025 dated 19.05.2026 at Annexure-H having been passed in contravention of principles of natural justice. (b) Direct Respondents closure of the CIRP of Lanarsy Infra Limited in light of the Petitioner's willingness to pay the entire claimed operational debt and its financial soundness; (c) In the alternative to prayer A and B above, remit the matter back to the Hon'ble NCLT Bengaluru for adjudication on merits without the order dated 19.05.2026 coming in its way; (d) Pass any other orders as deemed fit by this Hon'ble Court in the interest of justice and equity. - 3 - HC-KAR NC: 2026:KHC:31099 WP No. 16261 of 2026 2. Learned counsel for the petitioner has filed a memo, seeking permission of the Court to withdraw the writ petition. The said memo reads as follows: "The undersigned counsel for the Appellant herein prays this Hon'ble High Court to permit the counsel for the petitioner to withdraw the present case along with the Vakalathnama for the reasons mentioned hereinafter. The Hon'ble High Court has indicated that the appeal against the impugned order dated 19.05.2026 is maintainable before the Hon'ble National Company Law Appellate Tribunal. In furtherance of which the counsel for the petitioner has taken appropriate steps before the concerned forum. Hence in light of the above the counsel for the Petitioner most humbly prays that the present memo be taken on record and the above-captioned matter be allowed to be withdrawn since the petitioner has preferred an appeal before the Hon'ble National Company Law Appellate Tribunal, in the interest of justice and equity.” 3.
