1. Heard. 2. It transpires from the order dated 13.05.2026 (Annexure P2) that earlier, petitioner has filed petition which has been dismissed as withdrawn with liberty to avail appropriate remedy under the law. Subsequent to that, petitioner approached before the Real Estate Appellate Tribunal, Chhattisgarh, Raipur (for short, ‘Appellate Tribunal’) by filing an appeal under Section 44 of the Real Estate (Regulation and Development) Act, 2016 on 18.05.2026. Wp227 689 of 2026 2 the petitioner against the impugned order dated 20.04.2026, passed by the Chhattisgarh Real Estate Regulatory Authority, Raipur (RERA) in case No.M-PRO-2025-03300 (Shri Piyush Baid Vs M/s Abhinandan Galaxy). The petitioner prayed for the following reliefs:
“10.1 That this Hon’ble Court may kindly be pleased to set-aside the impugned order dated 20.04.2026 OR that it be remanded for the passing of a correct and proper order passed by learned Chhattisgarh Real Estate Regulatory Authority, Raipur, CG (for brevity ‘the RERA’) case no.M- PRO-2025-03300 (Shri Piyush Baid Vs M/s Abhinadan Galaxy) “RERA”, 10.2 This Hon’ble court may kindly be call for the records for its kind perusal which relates to petitioner’s matter. 10.3 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favor of the petitioner.”
3. The copy of appeal memo filed before the Appellate Tribunal is also annexed in the petition as Annexure P5 and from perusal of its reliefs claimed in paragraph-6, the same order has been challenged there also.
Paragraph-6 of the appeal memo (Annexure P5) is as under:
“6.1 It is, therefore, prayed that this Hon’ble court may kindly be pleased to allow this appeal and be pleased to set-aside the order dated 20/04/2026 passed by the learned Real Estate Regulatory Authority, Raipur CG in Complaint Case No.M-PRO-2025-03300 (Shri Piyush Baid Vs M/s Abhinadan Galaxy) in the interest of justice. 6.2 That this Hon’ble court may kindly be pleased to set-aside the impugned order dated 20-04-2026 OR that it be remanded for the

Since the challenge against the said order dated 20.04.2026 is already pending before the Appellate Tribunal, this Court is not inclined to entertain the present petition as the challenge of same order is pending before the Appellate Authority/Tribunal. 5.
