JUSTICE P SREE SUDHA ORAL ORDER Though this matter has come up for admission, with consent of learned counsel for the parties, the same is taken up for final hearing and disposed of by this order. 2. This petition is filed by the petitioners seeking transfer of S.C.No.726/2023 from the file of IX Addl. Judge Court of Small Causes and ACJM to XXXI Addl. City Civil and Sessions Judge, CCH-14, Bengaluru, to be tried along with O.S. No. 8457/2014, which is a suit for specific performance of an agreement of contract, and for ejectment of the suit schedule property. It is stated that both the cases are posted for arguments. It is further - 3 - HC-KAR NC: 2026:KHC:17938 CP No. 84 of 2026 submitted that an application has been filed in O.S.No.8457/2014 seeking amendment of the nature of the suit schedule property and the said application is posted for orders today. 3. Learned counsel for appellant mainly contended that both the matters are to be tried by one court to avoid conflicting of decisions. Further, it is stated that both the parties in both the matters are one and the same. Therefore, this Court finds that it is just and reasonable to transfer SC No. 726/2023 from the file of IX Addl. Judge Court of Small Causes and ACJM to XXXI Addl. City Civil and Sessions Judge-CCH 14 and to be tried along with OS No. 8457/2014, in order to avoid conflicting judgments.
