JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner call in question the proceedings in C.C.No.22564/2024 registered for an offence punishable under Sections 498(A), 323, 504 read with Section 34 of the Indian Penal Code, 1860 ('the IPC' for short) and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Ambekallu Shivaram, learned counsel appearing for the petitioner, Sri. K. Nageshwarappa, learned High Court Government Pleader appearing for respondent No.1 and Sri. Ajay G., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a - 4 - HC-KAR NC: 2026:KHC:30059 CRL.P No. 7938 of 2026 settlement and the memorandum of settlement reads as follows: "MEMORANDUM OF SETTLEMENT UNDER SECTION 89 READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named submit as follows:- 1. The petitioner has filed the above petition under Section 13 (1) (ia) of the Hindu Marriage Act 1955 against the respondent. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of mediation, the parties along with their counsel have participated and have identified each other and resolved their dispute and have agreed to the following terms and conditions: 1. The parties are Hindus by religion and they got married on 21.11.2021 at Balaji Kalyana Mantapa, Banagirinagar, B.S.K., 3rd Stage, Bengaluru 560085 Bangalore as per Hindu rites and customs and the same is registered on 18.01.2022 before the Registrar of Marriages, Banashankari, Bengaluru vide Marriage Registration Number: BSK-HM697-2021-22 and stored in CD Number: BSKM53. The petitioner is residing in Bengaluru within this jurisdiction of this Hon'ble Court. 2. The petitioner and the respondent have been living separately since 20.10.2022 and they have realized that they are not able to live together harmoniously and there is total incompatibility between them. 3. The petitioner and the respondent states that they have a male child born to them from this wedlock by name Cherish born on 04.12.2022 who is presently under the care - 5 - HC-KAR NC: 2026:KHC:30059 CRL.P No. 7938 of 2026 and custody of respondent/mother and continue to be so in future for which petitioner/father has no objection. The petitioner/father is at liberty to visit the minor child on 1st or 3rd Saturday once in a month at the place of Nyaya Degula in the office hours with mutual understanding with prior intimation to the respondent/mother. 4. The respondent/mother has agreed to bear all the expenses of the minor child as such education, medical, welfare and other upbringing expenditure. All further decision with respect to upbringing of the child will be done by the respondent/mother. The petitioner has agreed not to intervene in any kind with respect to the peaceful living of the respondent/mother and the child. 5. The petitioner has agreed to pay a sum of Rs.1,00,000/-(Rupees One Lakh Only) towards interim maintenance passed in M.C.No.7419/2022 on the file of the IV Addl.Prl.Judge, Family Court, Bengaluru. Above said amount shall be paid by way of demand draft on or before reporting settlement of the above case. 6. The petitioner shall execute the registered Gift Deed in respect of the property bearing Site No.210, bearing property No.150200302403722150 and Chikkanahalli Grama Panchayath Khatha No.25/10 carved out of property bearing converted Sy No.51, (converted vide Official Memorandum dated: 28.09.2015 bearing No.ALN. (S.T)SR/129/2013-14 issued by the Special Deputy Commissioner, Bangalore District, Bangalore), measuring East to West: 50 ft, and North to South: 30 ft, totally measuring 1500 Sq.Ft in the residential site, situated at Kurubarapalya Village, Tavarekere Hobli, Bangalore South Taluk in favour of the respondent on or before reporting settlement of the above case towards the - 6 - HC-KAR NC: 2026:KHC:30059 CRL.P No. 7938 of 2026 permanent alimony/maintenance as full and final settlement and the respondent has agreed for the same. 7. Both the parties state that they have already exchanged their valuable articles belonging to each other on 25.04.2026. 8. Both the parties have agreed that they have no claims of whatsoever nature against each other past, present or future or in respect of the moveable or immoveable properties of each other. 9. Both parties have withdrawn all the allegations against each other orally or expressly. 10. The respondent has agreed to co-operate to quash/close C.C.No.22564/2024 pending on the file of XXXVII ACJM., Bengaluru filed u/s.498(A), 323, 504 r/w S.34 of IPC and S 3 & 4 of the DP Act. 11. Both the parties undertake that they will not interfere in the lives of each other in future. 12. Both the parties agree and undertake not to approach at social media i.e. e-mail, video, instagram, facebook, twitter WhatsApp etc...with respect to the above case and not misuse any photographs/videos/digital footprints of each other in any kind in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Court be pleased to dissolve the marriage held on 21.11.2021 at Balaji Kalyana Mantapa, Banagirinagar, B.S.K., 3rd Stage, Bengaluru 560085 Bangalore as per Hindu rites and customs and the same is registered on 18.01.2022 before the Registrar of Marriages, Banashankari, Bengaluru vide Marriage Registration Number: - 7 - HC-KAR NC: 2026:KHC:30059 CRL.P No. 7938 of 2026 BSK-HM697-2021-22 and stored in CD Number: BSKM53 in terms of the aforesaid agreement. V. The Parties will appear on 28.04.2026 before the Hon'ble Court for passing orders in terms of the agreement." 4. In light of the settlement arrived at between the parties as afore-quoted, I pass the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings against the petitioners in C.C.No.22564/2024 pending on the file of 37th Additional Chief Metropolitan Magistrate Court, Nrupathunga Road, Bengaluru stands quashed.
