03/21.08.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Mirzachowki P.S. Case No.18/2017, registered for the offence under Sections 147, 148, 149, 336, 337, 332, 353, 307, 504, 506, 379 of the Indian Penal code and Section 54 of the M.M.R.D. Act, pending in the Court of the learned Sub-Divisional Judicial Magistrate, Sahibganj.

Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of one of the truck and the allegations are made of loading the stone chips on the said truck. She further submits that other co-accused owners and drivers of the trucks have been granted anticipatory bail by way of Annexures-3 to 7 in different A.B.As. She next submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 18 of this application. She also submits that the FIR has been registered against drivers and owners of 234 trucks.

Learned counsel appearing for the State opposed the prayer and submits that the truck was loaded with illegal stone chips and in view of that, the prayer for anticipatory bail may kindly be rejected.

Considering that the petitioner is owner of one of the truck and in identical situation, owners and drivers of trucks have been granted anticipatory bail by this Court in different A.B.As. contained in Annexures-3 to 7 and the petitioner is having no criminal antecedent, as disclosed in paragraph 18 of this applciation and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sahibganj in connection with Mirzachowki P.S. Case No.18/2017, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
