This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Jaynal Abdin @ Jaynal Abedin has prayed for bail in connection with Dispur P.S Case No. 975/2025 registered under Sections 305(e)/317(2) of BNS, 2023. 3. The brief facts of the case is that on 11-12-2025, one Bhaskar Mishra Bhagawati, Executive Engineer, New Guwahati Territorial Road Division, Guwahati lodged an FIR the Officer-in- Charge of Dispur P.S, inter alia stating and alleging that 8 Nos. of iron cattle traps were replaced and the said removed iron cattle traps were kept on the roadside near Pratiksha Hospital at VIP Road. However, in the last night, the said iron cattle traps were found missing. While inspecting the site, in the morning on 11-12-2205, one Section Assistant namely Sri Mrinal Pal Das found that the iron cattle traps were loading on to a Dumper Truck bearing Reg. No. ASO2CC9763 by a JCB bearing Reg. No. AS01LC6477. The individuals had managed to flee from the spot, however, the Section Assistant was able to capture photographs of JCB and the Dumper Truck. 4. On the basis of the information, the police arrested the present petitioner on 14.12.2025 at Pamohi and he led the police to the scrap shop of another co-accused Shaber Ali, where the stolen articles were recovered, which were already converted to smaller pieces. In this regard, the petitioner along with three other persons Page No.# 3/4 was also arrested. 5. It appears that other co-accused persons namely Shaber Ali, Sahil Ahmed @ Taslimuddin Ahmed and Chubur Bhuyan were granted bail by the learned Additional Sessions Judge, No.1, Kamrup(M) by orders dated 12.01.2026, primarily considering the nature of the offence and length of detention. The present petitioner has spent 45 days behind the bars. 6. Considering the nature of the offence as well as the length of detention, the prayer for bail is allowed. 7. Accordingly, the above-named petitioner is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) only with one surety of the like amount subject to the satisfaction of the learned Elaka Magistrate with following conditions: (i) That the petitioner shall cooperate with the investigation and appear before the I.O as and when called for; (ii) That the petitioner shall not hamper the investigation or tamper with the evidence. (iii) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer; (iv) That the petitioner shall not commit any similar Page No.# 4/4 offence; 8.
