Learned counsel for the petitioner submits that the petitioner is in custody since 04.05.2026 in connection with Barkagaon P.S. Case No: 56 of 2026 registered under Sections 64 and 351 (2) of the Bharatiya Nyaya Sanhita, 2023 and under section 4 of POCSO Act, now pending in the court of learned Additional Sessions Judge-IV cum Spl. Judge, POCSO, Hazaribagh. 3. Learned counsel for the petitioner further submits that although the FIR has been lodged for alleged offence under Sections 64 and 351 (2) of the Bharatiya Nyaya Sanhita, 2023 and under section 4 of POCSO Act, as the age of the victim has been disclosed as 17 years 10 months, but the actual age of the victim during medical examination was found to be more than 18 years. She submits that the charge sheet has not been submitted so far and the investigation is going on. 4. Learned counsel for the State has opposed the prayer for bail and has submitted that there is direct allegation against the petitioner and it is alleged that the petitioner entered the house of the victim and in spite of opposition, committed rape upon her on the pretext of marriage. 5. Considering the direct allegation made against the petitioner and the investigation is still going on, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 6.
