The present petition has been filed by the petitioner for directing the Collector Agrarian Reform (Tehsildar) Akhnoor to suspend the proceedings in the petition for partition titled, ‘Chanchla Devi & anr. Vs. Gourav Sharma & anr.’ in terms of Rule 12 of the J&K Partition Rules, 1970 till the possession is obtained from the competent court of civil jurisdiction. 2. Learned counsel for the petitioner submits that the petitioner has raised preliminary objections with regard to maintainability of the above mentioned petition, which the Collector is otherwise under legal obligation to decide. 3. In view of the above, the present petition is disposed of by requesting the Collector concerned to consider all the pleas raised by the petitioner including the preliminary objections and proceed in accordance with law. 4.
