This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Md. Raja Ahmed, praying for pre- arrest bail, apprehending arrest in connection with Helem P.S. Case No. 79/2025 registered under Section 303(2) of BNS, 2023. Page No.# 2/2 The allegation made against the petitioner is that while the informant was watching Rass Mahotsav at Balijan Kataki Chuk on 17.11.2025 at around 8.30 p.m. his E- Rickshaw was missing and the allegation against the petitioner is theft of E. Rickshaw and its battery. The E- Rickshaw was recovered but 4 Nos. of batteries of E. Rikshaw were not recovered. Hence, the FIR. The learned Addl. Public Prosecutor on perusal of the case dairy submits that there are sufficient materials implicating the petitioner in connection with theft of E Rickshaw and batteries. Having regard to the above, the present case is not considered to be fit case to grant the privilege of pre-arrest bail. Accordingly, prayer for bail stands rejected.
