Kaif, who is in custody since 15.07.2025 in connection with S.T. No. 319 of 2025 arising out of Bishunpura P.S. Case No. 36 of 2025 corresponding to G.R. No. 405 of 2025 for the offence registered under Section 64 of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Additional Sessions Judge-II, Nagar Untari, Garhwa, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that the victim girl has been examined as P.W. 1 during trial and she has not at all supported the prosecution case and was declared hostile on the prayer of the prosecution. Learned A.P.P. opposed the bail petition. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
