Heard the parties. The petitioner has been made accused in connection with Bishnugarh P.S. Case No. 140 of 2023 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons committed murder of her husband Naresh Kumar and caused disappearance of evidence of murder by throwing the dead body to screen herself and the co- accused person from the offence. It is next submitted that the allegation against the petitioner is false. It is submitted that on the basis of the report submitted by the petitioner U.D. Case was first registered and later on, this First Information Report has been registered on the basis of the written report submitted by the Sub- Inspector of the police. It is also submitted that the co-accused father and brother of the petitioner who faced trial in Sessions Case No. 13 of 2024 have been acquitted vide judgment dated 22.08.2025 as none of the witnesses could have stated about the involvement of any of
the accused persons or even the involvement of the petitioner herein in commission of murder of Naresh Kumar. It is next submitted that the petitioner has no criminal antecedents as mentioned in para 21, and she has been in custody since 06.05.2026 as has been mentioned in para 11 of the bail application. Though, charge-sheet has been submitted against the petitioner. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State opposes the prayer for bail of the petitioner.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Hazaribag in connection with Bishnugarh P.S. Case No. 140 of 2023 with the condition that she will co-operate with the trial of the case and furnish her mobile number and photocopy of the Aadhar Card in the court below with an undertaking that she will not change her mobile number during the trial of the case and she will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
