Mr. Saha, learned advocate appearing for the respondent no.5/Corporation raises an objection as to the entertainability of this writ petition in view of the alternative efficacious appellate remedy under Rule 51 of the West Bengal Minor Mineral Concession Rules, 2016. Faced with such situation, the learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to approach the Appellate Authority. The learned advocate for the petitioner submits that the petitioner shall prefer the appeal within a fortnight from the date of receipt of a server copy of this order. Accordingly, the writ petition stands dismissed as withdrawn with liberty to approach the appropriate forum. 2 In case the appeal is preferred by the petitioner before the appropriate authority within a period of 14 working days from the receipt of a server copy of this order, the Appellate Authority shall consider the said appeal on its merit and dispose of the same by passing a reasoned order without dismissing the same on the ground of limitation.
