The petitioner is apprehending his arrest in connection with Koderma PS Case No.59 of 2026, for offence registered under section 303(2), 317(2), 3(5) of BNS, 2023 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 and Rule 54 of Jharkhand Mines and Minerals Concession Rules, 2004, pending in court of learned Chief Judicial Magistrate, Koderma.

Learned counsel for petitioner submits that the petitioner happened to be owner of the tractor in question and the allegations are made of loading 1000 cft stone chips. He next submits that the said stone chips were loaded by one Munna Yadav and said Munna Yadav has been granted anticipatory bail in ABA No.2789 of 2026. He also submits that the petitioner is having no criminal antecedent as disclosed in paragraph no.14 of the petition.

4. Learned State counsel opposes prayer and submits that illegally the said stone chips were being loaded in the said tractor.

Considering that that the petitioner is the owner of the tractor and driver has stated that Munna Yadav has loaded the said stone chips and he has been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma PS Case No.59 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
