2026:JHHC:24894 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(C) No. 6603 of 2024 Birendra Kumar Singh, son of Ramkeshwar Singh, R/o at Kandu Mohalla Daltonganj, P.O.-GPO, Daltonganj, P.S.-Sadar Daltonganj, Dist.-Palamau, Jharkhand .... Petitioner(s) Versus 1. The State of Jharkhand through Secretary of Drinking Water & Sanitation, Department, Ranchi, Jharkhand. 2. The Engineer-in-Chief, Drinking Water & Sanitation, Department, Ranchi, Jharkhand. 3. The Executive Engineer, Drinking Water & Sanitation, Division, Latehar, At PWSD Office, P.O.-Latehar, P.S.-Latehar, Jharkhand. 4. The Assistant Engineer, Drinking Water & Sanitation, Division, Latehar, At PWSD Office, P.O.-Latehar, P.S.-Latehar, Jharkhand. … Respondent(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s): Mr. Sheo Kumar Singh, Advocate For the State: Ms. Nirupama, AC to Sr. SC-II ------ 03/18.08.2026 Heard the parties. 2. At the very outset, learned counsel for the State submits that the claim, arising out of the contract i.e. the admitted dues has already been paid. 3. In reply, learned counsel for the petitioner submits that 10% of the dues has been withheld for no reasons. 4. Learned counsel for the respondent by referring paragraph 9 of the counter affidavit submits that since the work was not completed within time frame mentioned in the agreement, the amount of 10% has been withheld. 5. Learned counsel for the petitioner submits that recommendation was given for extension of time, but it is not known whether the same was extended or not. 6. This clearly suggests that so far as balance 10% amount is concerned, there is some dispute between the parties, thus, it cannot be said that 10% dues, which remains, is admitted by the respondents. However, if the petitioner wants to make claim for 10% dues, it will be open to him to approach Civil Court of competent jurisdiction. 7. With the aforesaid observation and direction, this writ petition stand disposed of. Pending interlocutory applications, if any, stand disposed of.
