The present writ petition has been filed under Article 227 of the Constitution of India with the following prayers:- “(I) To set aside the judgment and order dated 01.08.2024 passed by the District Judge, Nainital in misc. civil appeal No.03 of 2024 (Annexure No.6) and further be pleased to uphold the order dated 03.06.2024 passed by the Civil Judge (Jr. Div.) Nainital in application No.6C filed in civil Suit No.09 of 2024 (Annexure No.4) (II) To pass such other or further order or direction as deemed proper under the facts and circumstances of the case in favour of the petitioner. (III) Award full cost of the petition.” 3. Mr. Tribhuwan Chandra Pandey, Advocate, submitted that the said Original Suit (No.9 of 2024) has already been dismissed.
