05/12.08.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Jhinkpani P.S. Case No.26/2025, registered for the offence under Sections 318(4), 338, 336(3), 61(2) of the BNS, 2023, Section 4 and 21 of M.M.D.R. Act and Rule 9, 11 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the Court of the learned Chief Judicial Magistrate, Chaibasa.

Learned counsel appearing for the petitioner submits that the petitioner is neither the owner nor driver of the truck in question. He further submits that the allegations are made of illegal transportation of iron ore. He then submits that even the petitioner is not the owner of mines. He next submits that only on confessional statement, the petitioner’s name has come. He also submits that the petitioner is having no criminal antecedent. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner.

Learned counsel appearing for the State vehemently opposed the prayer and submits that the petitioner is having 7 criminal antecedents and

false statement is made in paragraph 7 of this application that the petitioner is having no criminal antecedent.

Considering that the name of the petitioner has come on confessional statement and the petitioner is having criminal antecedents and for taking anticipatory bail, false statement is made in paragraph 7 of this application that the petitioner is having no criminal antecedent, however, the petitioner is having 7 criminal antecedents, as submitted by the learned counsel appearing for the State and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected.
6. Accordingly, this application is dismissed.
