This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to DEEPTI JHA Digitally signed by DEEPTI JHA 2 clear all the remaining dues of the petitioner pending before the authorities. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to consider the case of the petitioner by way of representation submitted by him. 10.4 Any other relief which this Hon’ble Court may deems fit and proper in favour of the petitioner may kindly be passed.” 3. Learned counsel for the petitioner submits that petitioner was Sarpanch and discharged his duties with uttermost honesty and for betterment of the Village he constructed Muktidham, roads, digging of wells, waiting rooms, renovation etc during his tenure. In this regard, petitioner acceded bills before the respondent authorities after the work done by him, but out of Rs.67,75,700/- only Rs.26,08,000/- has been released and payment of Rs.27,74,482/- is still pending. He further submits that copy of bills (Annexure-P/1) was filed by petitioner along with valuation report and a representation dated 04.11.2025 (Annexure-P/2) was also filed, despite that outstanding amount is still pending. Hence, learned counsel prays that this petition may be disposed of with a direction to respondent No.2/Chief Executive Officer, Janpad Panchayat, Raigarh, District Raigarh (C.G.) to decide the aforesaid representation (Annexure-P/2) preferably within a period specified by this Court. 4. Learned State counsel submits that the State is a formal party in the present case. 5. If the contractual work has been carried out by the petitioner, the petitioner ought not to be deprived of the fruits thereof, as it would otherwise give rise to various doubts. Therefore, considering the limited prayer made by counsel for the petitioner, the present petition is disposed of directing respondent No.2/Chief Executive Officer, Janpad Panchayat, Raigarh, District Raigarh (C.G.) to decide representation dated 04.11.2025 (Annexure-P/2) filed by 3 petitioner regarding payment of the outstanding dues payable to the petitioner, expeditiously, preferably within a period of 45 days from the date of receipt/submission of a copy of this order. 6. With the aforesaid observation and direction, the instant writ petition stands disposed of. 7. Interlocutory application(s), pending if any, also stands disposed of.
