The petitioner who is apprehending arrest in Crime No.65 of 2019 registered by Halasur Gate Police Station, Bengaluru City for offences punishable under Sections 466, 420, 464, 473, 471 & 468 of IPC, is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.65/2019 was registered by Halasur Gate Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, based on the first information dated 02.04.2019 received from Sri Ramachandra M, Chief Administrative Officer, Sessions Court, Bengaluru Rural District. Apprehending arrest in the said case, the petitioner had filed Crl.Misc.No.8664 of 2025 before the jurisdictional Sessions Court, which was rejected on 09.10.2025. Allegation against the petitioner is that he had produced forged documents along with his application seeking appointment to the post of peon. After completing investigation, charge sheet has been filed against the petitioner for the aforesaid offences. 5. Material on record would go to show that, petitioner was throughout absconding during the course of investigation and based on the documents available, charge sheet has been filed as against him. 6. Petitioner has not cooperated even before the trial Court after the charge sheet was filed and therefore coercive steps has been taken against him including issuance of non- bailable warrant and proclamation orders. 7. The Hon'ble Supreme Court in the case of STATE OF MADHYA PRADESH V PRADEEP SHARMA - (2014) 2 SCC 174 has observed that anticipatory bail application filed by accused as against whom proclamation orders are issued should not be entertained in normal circumstances. Under the - 4 - HC-KAR NC: 2026:KHC:30756 CRL.P No. 1463 of 2026 circumstances, I am of the view that the petitioner's prayer for grant of anticipatory bail needs to be rejected. 8.
