Since all the petitioners are in enjoyment and possession of the subject assigned lands, they made applications individually to the 2nd respondent for deletion of the subject lands from the prohibited list. However, pending
26
consideration of the same, the 4th respondent hurriedly issued the impugned notices dated 09.06.2025 alleging that the petitioners herein violated the conditions of assignment by not cultivating the subject lands as detailed in each individual notices of the 4th respondent dated 09.06.2025. For which the petitioners submitted their explanations separately dated 03.07.2025 stating that in the year 2023 approximately the resurvey department surveyed the lands and noticed the possession of the petitioners over the said lands and accordingly the revenue authorities issued pattadar passbooks and title deeds and the then Mandal Revenue Officer prepared LPM numbers confirming the assignment of land and possession of the same in favour of the petitioners and accordingly, the petitioners are entitled for free-hold of the subject lands as per the provisions of the Act 35 of 2023. Without considering the said explanations both on facts and law, the 4th respondent issued the impunged proceedings dated 26.07.2025 ignoring the explanations submitted by the petitioners on the individual basis. Uniformly without applying the mind, only on a short ground that the petitioners did not bring the assigned lands/ subject lands for cultivation within three years basing upon Google maps said to have been taken out, the 4th respondent passed the above said impugned orders. It was further observed in the above said impugned orders that the Google maps clearly shows that the land was not brought under cultivation and no clear demarcation of fencing exists on the ground. Hence, the written explanation submitted by the individual is not convincing as it is not proved. 27
He further alleges that the petitioners got mutated their names without any cultivation and possession, hence the entries are liable for cancellation. 5. On the other hand, the learned Assistant Government Pleader relying upon the written instructions from the 4th respondent dated 19.02.2026 submits that the statement showing the list of writ petitioners, assignment beneficiaries and present claimants on ground of POT Act case in Pisinikada Village, Anakapalli Mandal is as under:

The learned Assistant Government Pleader refers to the impugned
order of the 4th respondent dated 26.07.2025 and submits that the petitioners submitted their applications dated 13.08.2024 for deletion of the subject lands from the prohibited list before the 2nd respondent. Referring to the said applications, the office letter of the 4th respondent addressed to the 2nd respondent through the 3rd respondent dated 28.03.2025, the above said
31
show cause notices issued by the 4th respondent dated 09.06.2025 and explanations of the petitioners by considering all of them the above said impugned order was passed by the 4th respondent. But as per the table furnished above, he admits that the proceedings of the District Collector/ the 2nd respondent are dated 23.12.2025 and 14.08.2025 in respect of the petitioners which is much later to the impugned proceedings dated
26.07.2025. After considering the explanations submitted by the petitioners, conducting the field inspection of the subject lands and by referring to the Google maps, the above said observation was made by the 4th respondent in his order dated 26.07.2025, hence, the same may be sustained. 7. In view of the above said facts and circumstances, upon consideration of the rival submissions made and upon perusal of the material available on record, it is very clear that there is no enquiry conducted giving due opportunity of hearing for the petitioners and there is no physical participation of the petitioners in the above said enquiry at the time of field inspection as contended by the 4th respondent said to have been conducted and the whole finding and observation of the 4th respondent rests upon the Google maps as could be seen by the 4th respondent alone without having any opportunity for the petitioners to contradict or to explain further on it and the impugned proceedings of the 4th respondent dated 26.07.2025 is much prior to the proceedings of the District Collector/ the 2nd respondent on the applications of the petitioners for deletion of the subject properties from the prohibited list. 32
8. Therefore, the method and manner in which the enquiry was conducted by the 4th respondent before issuing the above said impugned orders dated 26.07.2025 is not in consonance with the well known procedures under law and the said impugned action of the 4th respondent is in gross violation of the principles of natural justice and contrary to the provisions of law.
In view of the same, there shall be a denovo enquiry pursuant to the above said notices issued by the 4th respondent dated 09.06.2025 to meet the ends of justice. For the said purpose, the petitioners are permitted to submit their additional explanations if any enclosing all the necessary documents in support of their claim to the above said notices of the 4th respondent dated 09.06.2025 within a period of four (4) weeks from the date of receipt of this order. On receipt of such additional explanations from the petitioners, the 4th respondent shall proceed with the necessary enquiry pursuant to the above said notices dated 09.06.2025 strictly in accordance with law by hearing all the parties concerned including the petitioners and others concerned giving due opportunity, upon verification of the records and the subject lands, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of four (4) months thereafter. 9. Pending the above said enquiry, there shall be an order of status-quo as on today to be maintained with respect to the subject lands as detailed in the above said notices of the 4th respondent dated 09.06.2025. Enabling the 4th respondent to proceed with the denovo enquiry, the impugned order of the
33
4th respondent dated 26.07.2025 is hereby set aside to pass fresh orders on merits uninfluenced by the said order dated 26.07.2025. 10. Accordingly, these writ petitions are disposed of. The written instructions of the 4th respondent dated 19.02.2026 shall be made as part of the court record. Interim order, if any, deemed to have been vacated. There shall be no order as to costs. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed. _________________________ JUSTICE B KRISHNA MOHAN 11.03.2026 NNN
