Heard Ms. Seema Singh, learned counsel for the petitioner as well as Mr. Sourabh Sahu, learned Panel Lawyer, appearing for the State/respondent No.1. 2. The present petition has been filed by the petitioner with the following prayer:- ANURADHA TIWARI Digitally signed by ANURADHA TIWARI Date: 2026.03.03 16:48:30 +0530 2 “It is, therefore, most respectfully requested that this Hon'ble Court may be pleased to grant quashment of FIR No. 0554/2025 dated 28.10.2025 registered at Police Station Akaltara, District Janjgir- Champa (C.G.) for the offence punishable under Section 498-A of the Indian Penal Code and all consequential criminal proceedings arising therefrom, in the interest of justice. It is further requested that this Hon'ble Court may be pleased to pass any other order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice.” 3. Learned State counsel submits that although the charge-sheet has already been filed on 08.12.2025, the same has merely been brought on record by learned counsel for the petitioner along with a covering memo dated 30.01.2026, and no consequential amendment has been carried out in the prayer clause of the writ petition so as to specifically assail the said charge-sheet. 4. In view of the aforesaid submission advanced on behalf of the State, learned counsel for the petitioner seeks leave of this Court to withdraw the present petition with liberty to institute a fresh petition incorporating an appropriate challenge to the charge-sheet. 5. Considering the above and without expressing any opinion on the merits of the case, the present petition is dismissed as withdrawn, with liberty to the petitioner to avail appropriate remedy in accordance with 3 law against the charge-sheet, if so advised and if the cause still survives. 6. Certified copies of all annexures appended with the petition shall be returned to learned counsel for the petitioner after retaining photocopies thereof on the record for reference.
