JUSTICE PRAMIL KUMAR MATHUR Order 22/04/2026 1. Apprehending his arrest in connection with FIR No.28/2026 registered at Police Station-New Mandi Hindaun, District-Karauli for the offences under Section 13 RPGO and Section 112(2) of BNS, 2023, the petitioner has preferred this bail application under Section 482 BNSS. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that the primary allegations are against the principal offender, Brijkishore @ Monu. The only allegation against the present petitioner is that his name appeared in the mobile phone of the said principal offender. No recovery is required to be effected from the petitioner’s possession. The petitioner is a cancer patient. The main offence is bailable in nature. He submits that the petitioner is [2026:RJ-JP:17021] (2 of 2) [CRLMB-4016/2026] ready to cooperate with the investigation. Hence, the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. Considering the fact that the petitioner has joined the investigation and is cooperating with the investigation of the case, but without commenting on the merits/demerits thereof, this Court deems it just and proper to allow the bail application of the petitioner. 6. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Pawan Singh S/o Rameshwar, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without prior permission of the court.
