The petitioner is before this Court seeking for the following reliefs; a) Issue a writ of certiorari quashing the notice dated 05.06.2026 issued by Respondent under Sections 179 and 94 BNSS 2023 to the petitioner vide Annexure-A; b) Grant such other relief’s as this Hon’ble Court deems fit to grant in the circumstances of the case. 2. What has been challenged is a police notice issued under Section 179 and 94 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023) by the Tamil Nadu Police Department. The respondent in the present matter is the Assistant Commissioner of Police, Chennai. 3. The contention of the learned counsel for the petitioner is that the petitioner residing in the jurisdiction of this Court, the Tamil Nadu Police Department could not have issued a notice to the petitioner within the jurisdiction of this Court under Section 179 of BNSS, 2023. Even if that were to be true, it is for the petitioner to agitate the same before the jurisdictional Court having jurisdiction over the Tamil Nadu Police Department, and in this - 3 - HC-KAR NC: 2026:KHC:30149 WP No. 18409 of 2026 case the Assistant Commissioner of Police, EDF-1, Central Crime Branch, Greater Chennai Police, Vepery Chennai. This Court not having jurisdiction over the said Assistant Commissioner of Police, Chennai, the very same submission made by the counsel for the petitioner in respect of Section 179 and 94 of BNSS, 2023 would apply to this Court. Hence, this Court cannot exercise any territorial jurisdiction over the matter. 4. Reserving liberty to the petitioner to approach the jurisdictional High Court, the petition stands disposed.
