Learned counsel for the petitioner submits that the petitioner was appointed as an Attendant on compassionate grounds on 22.04.2016 under the contingency fund establishment and his services were subsequently regularized by order dated 20.09.2021. Under the provisions of the Chhattisgarh Veterinary Class-III (Executive and Non-Ministerial) Service Recruitment Rules, 2009, 10% posts of Assistant Veterinary Field Officer are reserved for promotion of Attendant and as per the qualification, the Class-IV employee should have passed the departmental training i.e. Veterinary Polytechnic Diploma Course as departmental candidate and Higher Secondary 10+2 Examination with Biology Group with 5 years of service. Learned counsel 3 further submits that since the petitioner fulfilled the prescribed eligibility criteria, he applied for admission to the Diploma in Animal Husbandry and sought permission on 20.04.2026 to appear in the entrance examination scheduled for 28.06.2026. However, Respondent No. 3, by the impugned letter dated 22.05.2026, refused to grant permission to appear in the entrance exam which is scheduled on 28/06/2026. 3. On the other hand, learned State counsel submits that the impugned order dated 22.05.2026 has been passed pursuant to the Government Circular dated 09.02.2023, which keeps selection of Class-IV employees for the Veterinary Polytechnic Diploma Course, in abeyance. Learned counsel further submits that there is no illegality in the order impugned as the petitioner has not challenged the said Circular in the present writ petition. 4. I have heard learned counsel for the parties, perused the pleadings and documents. 5. On a pointed query made to learned counsel for the petitioner, he submitted that the Circular dated 09.02.2023 has not been supplied to the petitioner despite an application having been filed under the Right to Information Act seeking a copy thereof. However, a perusal of the writ petition and the pleadings reveals no averment regarding the filing of any such RTI application. 6. Be that as it may, the record discloses that the State Government, Livestock Development Department, has imposed a 4 complete prohibition on the selection of in-service/regular Class- IV employees, including Vaccinators, Dressers and Attendants, as departmental candidates for admission to the Veterinary Polytechnic Diploma Course until further orders. 7. Accordingly, the impugned order dated 22.05.2026 suffers from no illegality in light of the prohibition imposed by the Circular dated 09.02.2023. Since the said Circular has not challenged by the petitioner, the writ petition lacks merit and is hereby dismissed. SD/- (Bibhu Datta Guru) Judge Amardeep
