Petitioner appears in person and files affidavit-of- service and the same is taken on record. 2. By presenting this writ petition petitioner prays for direction upon concerned police authorities for registering FIR based on the complaint lodged against private respondents. 3. It is submitted that till date complaint of the petitioner is not transformed into an F.I.R. 4. State respondents, Kolkata Municipal Corporation and the private respondent nos. 10 to 13 are represented by learned Advocates. 5. Since petitioner has prayed for registering FIR, taking note of the complaint lodged, he has an 2 alternative remedy to approach jurisdictional Magistrate under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 6. In this regard reliance is placed on a judgment of the Hon’ble Supreme Court reported in (2007) 6 SCC 171 (Aleque Padamsee and Ors. vs. Union of India and Ors.). 7. Due to availability of alternative remedy, writ petition is not entertained and the same stands dismissed. 8. However, this order shall not preclude the petitioner to approach the jurisdictional Magistrate in pursuit of remedy. 9.
