IN THE HIGH COURT OF JHARKHAND AT RANCHI
C.M.P. No. 882 of 2026 ----- Rajiv Mandal, S/o Ghanshyam Sundi, R/o Station Road, Sariya, P.O. & P.S.-Sariya, District-Giridih
.......... Petitioner -Versus-
1. The State of Jharkhand
2. Kundan Kumar Singh, Sub-Divisional Officer, Bagodar Sariya, Giridih
3. Nitu Kumari, District Land Acquisition Officer, Giridih
.......... Opp. Parties -----
CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Ms. Nishi Rani, Advocate For Opp. Parties : None -----
Order No.02
Date: 14.08.2026
1. The present C.M.P. has been filed seeking recall/modification of the order dated 20.02.2026 passed in Contempt Case (Civil) No. 892 of 2023.
2. No one appears on behalf of the opposite parties.
3. Having heard learned counsel for the petitioner and on perusal of the record, it appears that the aforesaid contempt case was preferred by the petitioner alleging wilful and deliberate disobedience of the order dated 15.03.2023 passed in W.P. (C) No. 2074 of 2020. Perusal of the said order suggests that the submission of learned counsel for the opposite parties that the said order of this Court had been complied was also accepted by Ms. Diksha Rani, who had represented the petitioner in the said contempt case. Under the said circumstance, the proceeding of the Contempt Case (Civil) No. 892 of 2023 was dropped.

4. It further appears from perusal of the show cause affidavit filed on behalf of the opposite parsties in Contempt Case (Civil) No. 892 of 2023 that a reasoned order dated 05.10.2023 was passed by the District Land Acquisition Officer, Giridih in Miscellaneous Case No. 187 of 2022-23 considering and rejecting the petitioner’s claim for compensation with respect to the land in question.
5. If the petitioner was not satisfied with the said order dated 05.10.2023 passed by the District Land Acquisition Officer, Giridih, he should have taken appropriate recourse as permissible under law as against the same. Instead of taking said step, the petitioner has preferred the present petition seeking modification of the
order dated 20.02.2026 passed in Contempt Case (Civil) No. 892 of 2023, which in considered view of this Court, is not the correct remedy.
6. Under the said circumstance, the present C.M.P. cannot be entertained and the same is dismissed.
7. The petitioner is, however, given liberty to take appropriate recourse as permissible under law against the
order dated 05.10.2023 passed by the District Land Acquisition Officer, Giridih in Miscellaneous Case No. 187 of 2022-23.
