JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.4095/2025, pending before the Principal Civil Judge and JMFC, Bangarpet, Kolar, for the offence under Section 67 of the Information Technology Act, 2000. 2. Heard Sri.P.Prasanna Kumar, learned counsel appearing for the petitioner, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.Venkatachalapathi, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:30538 CRL.P No. 16889 of 2025 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with affidavits of father of the petitioner and the second respondent. The compounding application reads as follows: “The present petition is filed calling in question undated impugned order taking cognizance passed by the Principal Civil Judge and JMFC, Bangarpet, Kolar and the impugned charge sheet dated 30.07.2025 and 17.07.2025 filed by the 1st respondent/Bangarpet Police in Cr.No.24/2025 (CC No. 4095/2025) registered as against the petitioner alleging the commission of offences punishable under Section 67 of the IT Act. 2. It is submitted that since the present criminal proceedings arose out of the ancillary proceedings to the matrimonial discord between the petitioner and the sister-in-law of the 2nd respondent. The matrimonial discord has resulted in filing of various civil and criminal cases between the parties which came to be closed and quashed by this Hon'ble court on account of the joint memo of settlement filed by the petitioner and sister-in-law of the 2nd respondent due to the intervention of the elders in the family, the issues have been resolved and the parties to the lis have agreed to settle the dispute between them by entering into a compromise in Crl.P No. 3521/2026 and W.P 35889/2024 vide orders dt. 24.03.2026. 3. The present proceeding is an ancillary fall out of the afore stated proceedings. Since the main lis between the petitioner and the sister-in-law of the 2nd respondent is quashed on the account of the settlement arrived between them. The 2nd respondent has agreed to settled the lis between the petitioner in lieu of the above development. 4. The parties to this settlement undertake to abide by the terms and conditions stated in the preceding paragraphs and any breach of the terms and conditions by either of the parties, the aggrieved party will be at liberty to seek - 4 - HC-KAR NC: 2026:KHC:30538 CRL.P No. 16889 of 2025 appropriate remedies available under law for the quashing of the case in Cr.No.24/2025 (CC No. 4095/2025) registered as against the petitioner alleging the commission of offences punishable under Section 67 of the IT Act. Further, any orders passed by the Courts of law on the score of the present settlement shall be binding on all the parties to the lis. 3. It is submitted that in view of the settlement between the parties, this Hon'ble Court may permit the parties to amicably settle the dispute between them. WHEREFORE, it has become just and necessary for this Hon'ble Court to permit the petitioners and the 2nd respondent herein to; i) Compound the impugned proceedings in Cr.No.24/2025 (CC No. 4095/2025) registered as against the petitioner alleging the commission of offences punishable under Section 67 of the IT Act by the 1st respondent/Bangarpet PS pending on the file of the Principal Civil Judge and JMFC Court, Bangarpet and allow the present criminal petition by recording the compromise arrived between the parties, and; ii) Consequently, quash the impugned order taking cognizance dt.30.07.2025 passed by the Principal Civil Judge and JMFC, Bangarpet, Kolar and the impugned charge sheet dated 17.07.2025 filed by the 1st respondent/Bangarpet Police in NCR & Cr.No.24/2025 (CC No. 4095/2025) registered as against the petitioner alleging the commission of offences punishable under Section 67 of the IT by allowing the present criminal petition in Crl.P No. 16889/2025, in the interest of justice." 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with affidavits of father of the petitioner and that of - 5 - HC-KAR NC: 2026:KHC:30538 CRL.P No. 16889 of 2025 the second respondent and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
