04/21.08.2026 Heard learned counsel appearing for the petitioner, learned counsel appearing for the State and learned counsel appearing for the informant.
2. The petitioner is apprehending his arrest in connection with Adityapur P.S. Case No.282/2021(s), registered for the offence under Sections 406, 420, 408, 465, 467, 468, 471, 477-A, 34 of the IPC, pending in the Court of the learned Judicial Magistrate, 1st Class, Saraikela-Kharsawan.

Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. He further submits that the name of the petitioner has come on confessional statement of Aman Kumar Singh, against whom the main allegations are made of misappropriating the amount. He next submits that the said Aman Kumar Singh has been granted regular bail by the Coordinate Bench of this Court in B.A. No.3913 of 2022. He also submits that two of the co-accused have been further granted anticipatory bail in A.B.A. No.9037 of 2023 and A.B.A. No.4534 of 2026. He then submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 13 of this application.

Learned counsel appearing for the State and informant jointly opposed the prayer and submit that the petitioner in connivance with the said Aman Kumar Singh, has misappropriated the amount. On these grounds, they submit that the prayer for anticipatory bail may kindly be rejected.

Considering that the petitioner is not named in the FIR and his name has come on confessional statement and the main allegation is there against one Aman Kumar Singh, who has been granted regular bail in the aforesaid B.A. and further, two of the co-accused persons have been granted anticipatory bail in the aforesaid A.B.As. and the petitioner is having no criminal antecedent, as disclosed in paragraph 13 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saraikela- Kharsawan in connection with Adityapur P.S. Case No.282/2021(s), subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
