Accused no.4 in S.C.No.1718/2025 pending before the Court of LXVII Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.326/2019 registered by Kamakshipalya Police Station, Bengaluru City, for the offences punishable under Sections 143, 147, 148, 341, 302, 120B read with 149 IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. Material on record would go to show that on the merits of the case, petitioner was granted regular bail by this Court in Crl.P.No.4737/2020 disposed of on 06.10.2020. It appears that subsequently the case was committed to the jurisdictional Sessions Court and was numbered as S.C.No.1391/2022. Since the petitioner had not appeared before the Trial Court in S.C.No.1391/2022, a split-up case was registered against him in S.C.No.1718/2025 and steps were taken to secure his presence. Petitioner was arrested in S.C.No.1718/2025 and produced before the Trial Court on - 3 - HC-KAR NC: 2026:KHC:30906 CRL.P No. 7560 of 2026 08.12.2025 and on the said date, he was remanded to judicial custody. This Court while granting regular bail to the petitioner in the present case in Crl.P.No.4737/2020, has observed that there are no allegations of any serious overt act as against the petitioner herein, except stating that he was also present at the time of alleged incident. 4. Petitioner who was granted regular bail on the merits of the case, is now in custody for the reason that he had not appeared before the Trial Court on the regular dates of hearing. In the other cases registered against the petitioner, he is said to have been enlarged on bail. The apprehension of the learned HCGP can be taken care of by imposing appropriate conditions. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.1718/2025 pending before the Court of LXVII Addl. City Civil & Sessions Judge, Bengaluru, - 4 - HC-KAR NC: 2026:KHC:30906 CRL.P No. 7560 of 2026 arising out of Crime No.326/2019 registered by Kamakshipalya Police Station, Bengaluru City, for the offences punishable under Sections 143, 147, 148, 341, 302, 120B read with 149 IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.2,00,000/- with one surety for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off; - 5 - HC-KAR NC: 2026:KHC:30906 CRL.P No. 7560 of 2026 f) Petitioner shall mark his attendance before the Station House Officer, Kamakshipalya Police Station, Bengaluru City, on the first Sunday of each month between 10.00 a.m. and 1.00 p.m. till the case registered against him is disposed of.
