The petitioner is apprehending his arrest in connection with Gumla P.S. Case No.246 of 2026 for the alleged offences registered under Sections 115(2), 117(2), 126(2), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the altercation took place due to dispute of parking. He further submits that false allegations are made against the petitioner of assault. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that allegations are there of assault upon the informant 2026:JHHC:24731 --2-- A.B.A. No. 4583 of 2026 by iron pipe twice on the head and in view of that anticipatory bail may kindly be rejected. 5. On perusal of the FIR it transpires that there is direct allegation of assault against the petitioner on the head twice by iron pipe and in that view of the matter I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
