Mr. B.D. Pande, learned counsel for the petitioner. 2. Mr. R.C. Joshi, learned Brief Holder for the State of Uttarakhand. 3. In this writ petition, petitioner has sought the following reliefs:- (i) A writ, order or direction in the nature of certiorari quashing the impugned report dated 05.11.2020 (Annexure no. 7) and 29.01.2021 (Annexure No. 10) whereby respondent no. 3 submitted the report against the claim of petitioner for appointment on compassionate grounds. (ii) A writ, order or direction in the nature of mandamus commanding the Respondents to consider the case of the petitioner for compassionate appointment on the post for which petitioner is legally entitled. 4. Learned State Counsel submits that Annexure 7 and Annexure 10 to the writ petition, which are impugned by petitioner, are the reports submitted by Chief Treasury Officer, Almora to the Appointing Authority. He submits that petitioner’s claim has not been rejected, as per the documents enclosed with the writ petition. 5. This Court finds substance in the submission made by learned State Counsel. The report, if any, submitted by the Authorities to the Competent Authority, cannot be challenged unless the Competent Authority has acted upon those reports by rejecting the claim of 2026:UHC:2099 the petitioner. 6. In such view of the matter, the writ petition is disposed of with a direction to the Competent Authority to take decision, if already not taken, on petitioner’s claim for compassionate appointment, as per law, within six weeks from the date of presentation of certified copy of this order.
