K GANI REDDY Counsel for the Respondent(S): 1. GP FOR HOME The Court made the following: SRK, J W.P.No.25428 of 2021 3 O R D E R This Writ Petition was filed seeking the following relief: “…to issue an appropriate Writ, Order or direction particularly one in the nature of Writ of Mandamus, declaring the inaction of respondent No.7 in registering a case against the respondent Nos.8 to 11, as illegal, arbitrary, unjust and unconstitutional and consequently, direct the respondent No.7-Police to provide protection to the Writ Petitioner from the respondent Nos.8 to 11 and their henchmen by registering a case against them and to pass such other order…” 2. Grievance of the Writ Petitioner is that though he lodged a report with respondent No.7-Police against the respondent Nos.8 to 11, the respondent No.7-police did not register any case as against the respondent Nos.8 to 11. 3. Today, when the matter is taken up for hearing, learned Assistant Government Pleader for Home representing Official respondents would submit that the respondent No.7-police did not receive any report from the Writ Petitioner. According to the learned Assistant Government Pleader for Home, the material that has been filed along with the Writ Petition shows that acknowledgment issued in respect of the report is of Kodavalur Police Station and in view of the same, the allegation made against 7th respondent, who is Station House Officer of Kovvur Police Station, in the Writ affidavit is baseless. 4. Heard both sides. Perused the material available on record. SRK, J W.P.No.25428 of 2021 4 5. A perusal of the cause title of the Writ Petition goes to show that respondent No.7 is the Station House Officer, Kovvuru Police Station, SPSR Nellore District, Andhra Pradesh. But, as per the contention of learned counsel for the Writ Petitioner and also as per the written instructions submitted by the learned Assistant Government Pleader for Home, the acknowledgment issued for receipt of report lodged by the Writ Petitioner pertains to Kodavalur Police Station. In view of the same, the Writ Petition is not maintainable and it is devoid of merit and force. 6. Accordingly, the Writ Petition is dismissed. However, it is open to the Writ Petitioner to avail the remedies available to him in accordance with law. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. ___ __________ JUSTICE K. SREENIVASA REDDY 30th March, 2026. DNB
