JUSTICE ANJAN MONI KALITA ORDER Date : 17.02.2026 Heard Mr. M. Kalita, learned counsel appearing for the accused-applicant. Also heard Mr. K. K. Parasar, learned Addl. Public Prosecutor, representing the State respondent. Vide an order dated 09.02.2026, this Court has directed personal appearance of Page No.# 2/3 the concerned I/O, namely, S.I. Pranjal Baruah before this Court. Accordingly, the aforesaid Pranjal Baruah has appeared before this Court producing the Case Diary. It is to be mentioned herein that in spite of 6(six) orders passed by this Court on earlier occasions, Case Diary was not produced before this Court. Therefore, a direction was passed by a Co-ordinate Bench of this Court on 30.01.2026, directing the aforesaid Pranjal Baruah to be personally present before this Court on the next date fixed. The same was communicated to him by the Registry as well as a communication was sent to the Superintendent of Police, Golaghat also. In spite of receipt of the said communication, the aforesaid S.I. Pranjal Baruah, on 09.02.2026, did not appear personally before this Court, rather, he sent a W.T. message to the Registry in the morning, intimating that he had to leave for Rajasthan in connection with a case and therefore, he would not be able to attend the Court proceeding. On 09.02.2026, this Court had directed aforesaid S.I. Pranjal Baruah to be personally present again today, with a communication sent to the Superintendent of Police, Golaghat. Today, when the Case Diary was placed before this Court, it is seen that the Case Diary is not updated since 09.10.2025. When the same was enquired, aforesaid S.I. present could not give any convincing answer to the Court. In view of the aforesaid, this Court is constrained to communicate to the superior officer i.e., the Superintendent of Police, Golaghat to take necessary action against the S.I. Pranjal Baruah as he deems fit. Since the Case Diary is not an updated one and this Court had already granted interim protection to the accused-applicant, this Court is of the considered view that interim protection so granted to the accused-applicant should be made absolute. Accordingly, the instant anticipatory bail application is disposed of by making the earlier order dated 30.01.2026, absolute, in same terms and conditions as has been stated Page No.# 3/3 therein. Registry is directed to communicate the instant order to the Superintendent of Police, Golaghat, with a copy to the concerned S.I. Pranjal Baruah. Personal appearance of the S.I.
