By way of the instant writ petition, the petitioner, who is the wife of the deceased employee namely Ravi Kaushik, has sought a direction towards the respondent authorities to consider the case of the petitioner for pensionary benefits. 2. Learned counsel for the petitioner would submit that the succession certificate which is requisite for preparing pension case has also been ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.06.25 17:55:03 +0530 2 / 2 issued by the competent Court and the same will be produced before the competent authority i.e. Respondent No.2. He would therefore, submit that the instant petition be disposed of directing the Respondent No.2 to consider the case of the petitioner with regard to entitlement and release of the pension to the petitioner. 3. Learned counsel for the Respondents, on instructions, would submit that if the petitioner submits fresh application along with the succession certificate the same shall be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the documents. 5. Considering the submissions made by learned counsel for the parties, the petitioner, who is the wife of the deceased employee, is permitted to make the fresh representation along with the requisite documents and on such representation being filed, the Respondent No.2 shall decide the same within a period of 30 days from the date of receipt of the representation in accordance with law. 6. With the aforesaid observation, the instant writ petition stands disposed of. 7. It is made clear that this Court has not expressed any opinion on the merits of the case and the Respondent no.2 shall proceed in the matter in accordance with law on its own merits.
