Goverdhan, Sr. Advocate with Mr. Rakesh Thakur, Advocate, for the applicant. The instant application has been filed for release of the decretal amount, lying deposited in the Registry of this Court, in a decided case i.e. RSA No. 90/2025, which stands disposed of vide judgment, dated 16.03.2026, stating therein that the applicant is in dire need of money. On 18.08.2026, when the instant application came up for consideration, learned counsel for the non- applicant sought and was granted time to have instructions as to whether an appeal has been preferred by the non-applicant against the aforesaid judgment before the Hon’ble Supreme Court. Today, it is submitted by the learned counsel for the non-applicant that she has no instructions from the non-applicant. Learned senior counsel for the applicant, on instructions, submits that no appeal has been preferred by the opposite party till date. In view of the averments, as made in the application, which is duly supported by an affidavit, the instant application is allowed and the entire decretal amount, which is lying deposited in the Registry of this Court, along with upto date interest, is ordered to be released in his favour by remitting the same to his bank accounts, details whereof have been given in para 7 of the application, with a direction to the applicant to file an affidavit before the Registrar (Judicial) to the effect that in case, any appeal is preferred by the non-applicant and adverse order is passed therein against him, in that event, he shall refund the entire decretal amount along with upto date interest to the non-applicant.
