ORAL ORDER
The petitioner is before this Court calling in question proceedings in Spl.C.C.No.2839/2022 arising out of crime No.83/2022 registered for the offence punishable under Section 20(b) (ii) B, 8) of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('the NDPS Act' for short).
2. Heard Sri. Prakasha K.V., learned counsel appearing for the petitioner and Smt. Waheeda M.M., learned High Court Government Pleader appearing for the respondent.
3. The petitioner is the accused, who gets embroiled in a crime for offences punishable under the NDPS Act. The proceedings are being tried in Spl.C.C.No.2839/2022. The petitioner fails to appear before the concerned Court on repeated dates. Therefore, the concerned Court issues a proclamation against the petitioner. The petitioner is now before the Court on the score that the procedure that is

necessary to be followed for issuance of proclamation has been violated in the case at hand. Be that as it may.
4. The learned counsel appearing for the petitioner would further submit that the next date of listing before the concerned Court is 13.07.2026. In that light, I deem it appropriate to dispose the petition with a direction to the petitioner to appear before the concerned Court on 13.07.2026. On subject to the said condition, the order of proclamation shall stand suspended.
5. In the event, the petitioner would not appear before the concerned Court on the next date of listing i.e., 13.07.2026, the concerned Court is at liberty to pass necessary orders in accordance with law.
6. With the aforesaid observation, the petition stands
