This petition is filed seeking following reliefs: (i) Set aside the order dated 27.09.2023 in Case No.Ka Ka A Ben/UPaKa/CR-118/2022- 2023 passed by the Labour Officer and Controlling Authority of Payment of Gratuity Act, Sub-Division-2, Karmika Bhavan, - 3 - HC-KAR NC: 2026:KHC:30715 WP No. 2517 of 2026 Bannerughatta Road, Bengaluru vide (Annexure-A). (ii) Pass such other order or direction as this Hon'ble Court deems fit and proper under the facts and circumstances of the case, in the interest of justice and equity. 3. The order dated:27.09.2023 passed by the Controlling Authority under the Payment of Gratuity Act is called into question in this Writ Petition on several grounds as set-out in the Memorandum of Writ Petition. 4. AGA for the petitioners urged several contentions. 5. Heard, the contentions urged on behalf of the Additional Government Advocate for petitioners and perused the writ papers with utmost care. 6. I have perused the Writ papers with utmost care. The Government has challenged the order passed by the Controlling Authority, by invoking writ jurisdiction without exhausting the statutory remedy. As there is a statutory remedy of filing an appeal before the Appellate Authority, this - 4 - HC-KAR NC: 2026:KHC:30715 WP No. 2517 of 2026 Court declines to exercise power under writ jurisdiction.
