Rights in Land and Pattadar Pass Books Act, 1971 and the Survey and Boundaries Act, 1923, and consequently set aside the same, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pieased to grant an interim stay of all further proceedings pursuant to the impugned notice (Ref:R.C.B/79t/2026.dt. 21.04.2026) issued by the 4th Respondent in respect of the petitioners land admeasuring an extent of Ac. 0.375 cents situated in Sy.No. 1611-2A of Kothapalle Village. The Court made the following ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondent Nos.1 to 5. 2. The issuance of notice to the 6th respondent is dispensed with, as no prejudice would cause to him, even if it is disposed of in his absence. 3.
This Writ Petition is filed questioning the notices issued by the 4th respondent dated 07.03.2026, 07.04.2026 and 21.04.2026, calling for enquiry on the basis of the representation given by the 6th respondent dated
23.02.2026. 4. The learned counsel for the petitioner submits that though the suit is pending with respect to the subject property, on the frivolous representation of the 6th respondent, the 4th respondent issued the above said notices to conduct enquiry in the matter of mutation of names of the parties concerned for the subject land in the online records. 5. The learned counsel for the petitioner further submits that for the subject land, the petitioner’s name is mutated in the revenue records based upon the registered sale deed. At the behest of the false representation given by the 6th respondent dated 23.02.2026, the enquiry was initiated by the 4th respondent, which is impugned in this Writ Petition. The unofficial 6th respondent is relying upon the gift settlement deed. 6. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1 to 5 submits that it is only a notice issued by the 4th respondent and if the petitioner submits any explanation to it, the

same would be considered by the authorities concerned, following the due procedure. 7. In reply, the learned counsel for the petitioner submits that the petitioner gave legal notices dated 16.03.2026 and 15.04.2026. 8. In view of the above said facts and circumstances, the petitioner is permitted to submit her explanation to the above said notices of the 4th respondent dated 07.03.2026, 07.04.2026 and 21.04.2026, enclosing all the necessary documents in support of her claim, within a period of two (02) weeks from the date of receipt of copy of this Order.
On receipt of such explanation from the petitioner, the 4th respondent shall proceed with the necessary enquiry, pursuant to the above said notices dated 07.03.2026, 07.04.2026 and 21.04.2026, strictly in accordance with law, by hearing all the parties concerned, including the petitioner and the 6th respondent, giving due opportunity, upon verification of the records, the explanation of the petitioner, the representation of the 6th respondent and the subject land covered under the impugned notices dated 07.03.2026, 07.04.2026 and 21.04.2026, appropriate decision shall be taken on its own merits, as expeditiously as possible, preferably, within a period of three (03) months thereafter. Pending the enquiry, there shall be an order of status-quo as on today to be maintained with respect to the mutation of the names of the parties concerned for the subject land covered under the impugned notices of the 4th respondent dated 07.03.2026, 07.04.2026 and 21.04.2026. The petitioner is permitted to raise

the jurisdictional aspect in the explanation that is going to be submitted before the said authority concerned. 9. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
